Secret Nature vs. Bay Smokes: Two THCa Storefronts, Judged on the Banner Over Every Page
One storefront prints '100% Federally Legal Products' above its whole catalogue. The other prints a shipping threshold. Nine weeks from a total-THC standard that counts THCa, the louder banner is the one with a clock on it.
The strip that sits above a storefront’s catalogue is the only copy a shopper cannot scroll past. It loads on the product page, the cart, the contact form, the 404. Whatever it says, the company is saying on every page it owns.
So that is what this grades. Not how the flower smokes — we opened nothing, lit nothing and measured nothing — but what two THCa-first sellers commit to in writing in their own site chrome, read on 6 September 2026, nine weeks out from a date this site has been mapping all year.
What each banner says
Fetched 6 September 2026, Secret Nature’s chrome carried four standing lines: “Ships to All 50 States”, “3rd Party Lab-Tested”, “100% Federally Legal Products” and “Trusted by 200k+ People”, with “Free shipping over $99” beneath and a Shop By Cannabinoid menu naming THCA, CBD, Delta 9 THC, CBN, CBG and Delta 8 THC. Those are the company’s words, quoted, not ours.
Bay Smokes’ chrome on the same day carried one line above the fold: “Free standard shipping on all orders over $100+!” Behind it, a THCA-led menu — flower, smalls, vapes, seeds, pre-rolls, concentrates — and a rail of named customer testimonials. No fifty-state line and no legality line appeared in what its pages returned to us.
Why the loud one is the risky one
Public Law 119-37 is enacted law, approved 12 November 2025, and its hemp redefinition takes effect a year after enactment — 12 November 2026. The enacted text turns on total tetrahydrocannabinols, THCa included, at a ceiling of 0.4 milligrams per container, alongside its tests for cannabinoids the plant cannot naturally produce and for cannabinoids synthesised outside it.
THCa flower is precisely the product class that arithmetic is aimed at. And the partial delay signed earlier this month does not rescue it: what section 2019 actually postpones is narrower than a new date implies, and the milligram ceiling is not the part that moved.
Set that against a banner reading “100% Federally Legal Products” over a THCA Flower menu. Delta Dossier is not asserting that anything either firm sells is legal, illegal, licensed or compliant anywhere; we checked no regulator and neither should you take our word for it. The point is narrower and, we think, harder to argue with: a blanket present-tense legality guarantee printed site-wide is a claim with a clock on it, and the clock is nine weeks from ringing. Bay Smokes’ chrome, in the material we could open, printed no such guarantee to retract.
Quiet is not the same as careful
That cuts the other way too, and this is where a lazy review would stop. A banner that says less tells the shopper less.
Secret Nature’s chrome at least commits to third-party lab testing — the panel-and-batch discipline this site keeps asking for — and states plainly which cannabinoids are on the shelf. Bay Smokes’ chrome commits to a shipping threshold. Testimonials are not a certificate of analysis; “Verified Buyer” attests that someone bought something, not that anyone assayed it.
“Trusted by 200k+ People” is a vendor marketing figure and we treat it as one. The company says it; nobody audited it for you.
What we could not read, and will not pretend to
Both storefronts are JavaScript-rendered, and a plain fetch returns their chrome rather than the prose behind it. On 6 September no per-state exclusion list came back from either — not from Bay Smokes’ shipping-policy URL, and not from Secret Nature, whose conventional lab-results and shipping-policy paths returned the store’s own 404 page while still rendering the full banner.
That is a limit on our fetch, not a finding about their policies. We are not saying either seller lacks a state list; we are saying we could not retrieve one this way, and neither can a shopper skimming the header. Which returns you to the reflex: check your state. THCa flower is treated very differently across state lines, and no banner — loud or quiet — changes what is lawful where the package is delivered.
The ledger
Verdict
Banner copy is live marketing and can change the day after we publish; everything above is quoted as it stood on 6 September 2026. The FDA has evaluated none of what either company sells, we make no claim about what any of it does and name no amount for anyone to take, and the buyer must be 21 or over in a state that permits the sale at all. Read the strip at the top of the page as advertising. It is not a legal opinion, and it is not your state’s.
